Terms of Service
Legal terms and conditions for TruHealth Pros services. Effective January 2026.
1. Acceptance of Terms
By engaging with TruHealth Pros for health advocacy services, you agree to be bound by these Terms of Service. If you do not agree to all of the terms and conditions below, do not use our services.
2. Description of Services
TruHealth Pros provides personal health advocacy and care coordination services delivered by licensed Nurse Practitioners. Our services include:
- Comprehensive health audits and medication reviews
- Attendance at medical appointments (in-person or virtual)
- Medication safety audits and interaction analysis
- Coordination between specialists and primary care providers
- Family communication via secure portal (SITREPs and updates)
- 24/7 access to your dedicated NP (for Gold tier clients)
- Care planning and medical record organization
Our services are offered at two membership tiers: Silver (Remote Advocacy) and Gold (Full Concierge). Service specifics are detailed in our current service menu and enrollment agreement.
3. Not a Substitute for Medical Care
Important: TruHealth Pros provides advocacy and care coordination, not primary medical care. Our NPs do not serve as your personal physician or primary care provider. Our services support and complement relationships with your existing treating physicians, specialists, and primary care providers.
Nothing in our services constitutes medical diagnosis, treatment, or clinical decision-making that replaces your physician’s judgment. TruHealth Pros NPs provide coordination, education, and second-opinion consultation only.
4. Client Eligibility and Service Area
Service Area: TruHealth Pros operates in Sarasota-Manatee County, Florida (including Lakewood Ranch, Longboat Key, and Venice). Services may be expanded to other areas at our discretion.
Eligibility: Our services are designed for adults age 65 and older, and for adult children or family members who manage their care. We reserve the right to decline service to prospective clients if we determine we cannot provide appropriate care due to geographic, clinical, or capacity constraints.
5. Service Agreement and Enrollment
Engagement with TruHealth Pros requires execution of a formal Service Agreement that specifies:
- Tier selection (Silver or Gold) and associated fees
- Term of service (typically month-to-month or annual)
- Payment schedule and method
- Emergency contact information and authorized family representatives
- Consent to HIPAA-compliant care coordination
The Service Agreement supersedes these general Terms of Service where there is a conflict. Both documents form the complete agreement between you and TruHealth Pros.
6. Fees and Payment
Membership Fees
- Silver Plan: $1,000/month (Remote Advocacy)
- Gold Plan: $2,000/month (Full Concierge)
Fees are billed monthly in advance or annually at a 5% discount, as specified in your Service Agreement. All fees are private pay — no insurance billing.
Additional Charges
Additional services outside your membership tier (e.g., extended family consultations, additional appointment attendance, specialized care coordination) may incur separate fees as agreed in writing.
Payment Methods
We accept credit card, bank transfer, and check payments. Invoices are sent via email at the beginning of each billing cycle. Late payments may result in service suspension.
Refund Policy
Membership fees are non-refundable once the billing period begins. If you cancel mid-month, you are responsible for the full monthly fee. Upon termination, we will provide your medical records within 30 days at no charge.
7. Term and Termination
Initial Term
Memberships are typically month-to-month unless you select an annual plan. The initial term is specified in your Service Agreement.
Cancellation by Client
You may cancel your membership with 30 days written notice. Cancellation must be submitted via email to hello@truhealthpros.com or by phone at (941) 300-0368. Your final billing will include fees through the cancellation date.
Termination by TruHealth Pros
TruHealth Pros may terminate your service with 30 days notice for:
- Non-payment of fees (after 15 days written notice)
- Material breach of this Service Agreement
- Conduct that violates professional healthcare standards or is abusive to staff
- Clinical circumstances that make continued safe care coordination impossible
- Relocation outside our service area
Upon termination, we will transfer your medical records to a provider of your choice within 30 days at no charge.
8. Client Responsibilities
To ensure safe and effective care coordination, you agree to:
- Provide accurate information: Disclose all medical conditions, medications, allergies, and physician names at enrollment and update us of any changes
- Authorize appointment access: Sign authorization forms allowing our NP to attend your medical appointments (in-person or virtual) and to review medical records from your physicians
- Maintain physician relationships: Continue to see your treating physicians and primary care provider. TruHealth Pros does not replace these relationships
- Follow medical advice: While TruHealth Pros provides guidance, you retain the right to accept or decline medical recommendations from any provider, including our NPs
- Communicate clearly: Inform us of changes to your medical status, new diagnoses, hospitalizations, or emergency situations as soon as possible
- Pay fees on time: Remit membership fees by the due date specified in your invoice
9. Limitations of Liability
No Warranty: TruHealth Pros provides services on an “as-is” basis. We do not guarantee any specific health outcomes, medical results, or improvements in your health status.
Third-Party Actions: TruHealth Pros is not responsible for the actions, negligence, or omissions of your treating physicians, hospitals, pharmacies, or other third-party healthcare providers. Our role is coordination and advocacy, not oversight of the clinical decisions made by your care team.
To the fullest extent permitted by law, TruHealth Pros’s total liability for any claim arising from these Terms or your use of our services shall not exceed the total fees you paid in the 12 months preceding the claim. Some jurisdictions do not allow exclusion of implied warranties, so these limitations may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless TruHealth Pros, its owners, employees, and agents from any claims, damages, or expenses (including attorney’s fees) arising from:
- Your use of our services or violation of these Terms
- Your breach of any representation or warranty made to us
- Your violation of any applicable law or third-party right
- Bodily injury or property damage caused by your actions
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflicts of law principles. Any dispute arising from these Terms shall be subject to the binding arbitration clause in your Service Agreement. If no arbitration clause is present, disputes shall be resolved in the state or federal courts located in Sarasota County, Florida, and you consent to personal jurisdiction in those courts.
12. Confidentiality and Nondisclosure
Both you and TruHealth Pros agree to maintain the confidentiality of all sensitive information shared during the engagement, including health information, financial information, and internal business practices. This obligation survives termination of services.
13. Amendments to Terms
TruHealth Pros may amend these Terms of Service at any time. If material changes are made, we will notify you via email or mail at least 30 days prior to the effective date. Continued use of our services after the effective date of any amendment constitutes your acceptance of the amended Terms.
14. Entire Agreement
These Terms of Service, together with your signed Service Agreement, Privacy Policy, and any other documents referenced herein, constitute the entire agreement between you and TruHealth Pros regarding your engagement with our services. Any prior understandings, negotiations, or agreements not expressly set forth herein are superseded.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
